Chinese Drywall Class Action Settlement

Almost three years after the first Chinese Drywall case was filed, a class action settlement agreement has been reached with one of the manufacturers of defective Chinese drywall that has damages affecting thousands of consumers in Florida and throughout the Southeastern United States

A Georgia Court preliminarily approved an amended settlement agreement negotiated in October 2010 between Lowe's and a class of plaintiffs impacted by defective drywall purchased at the home improvement super store

Today Florida's Fourth District Court of Appeal ruled in McKenzie Check Advance v. Betts that the class action bans that payday lending companies put in their consumer contracts are void because they violate public policy. For years, payday lending companies prevented consumers from vindicating their rights under the Florida Deceptive and Unfair Trade Practices Act and the Florida Civil Remedies for Criminal Practices Act by inserting class action bans in their contracts.

Lowe's and attorneys representing a class of plaintiffs announced today they have agreed to an amendment submitted to Judge Bobby Peters in Columbus, Georgia to their proposed national drywall class action settlement that will provide up to $100,000 in compensation for qualified claimants.
